Public Auction of the Succession of Pierre Guédry Père of St. Martin Parish, Louisiana, 17-20 January 1826

In the last edition of "Generations" (Spring 2025, Vol. 23 No. 1, p.33) we discussed the Last Will and Testament of Pierre Guidry of St. Martin Parish, Louisiana. 1 Pierre Guidry, born at Merliguèche, Acadie (near today's Lunenburg, Nova Scotia) about 1741 suffered through a tragic deportation and resettlement in Louisiana after being exiled to North Carolina and later residing in Pennsylvania, New Jersey and Maryland. His is a story of rags to riches for he was one of the Acadians that through hard work accumulated wealth before he died on 14 November 1825 near present-day Cecilia in St. Martin Parish, LA.

His life in Acadie, during the deportation years and in Louisiana are outlined in the previous edition of "Generations". During his stay in Louisiana, he accumulated a significant estate despite having 21 children and three wives - each of whom left him widowed.

About 1764 Pierre married Marguerite Dupuis by whom he had two children. Marguerite and both young children died in the summer of 1768 at San Luis de Natchez, LA (near present-day Vidalia, Concordia Parish, LA).

On 23 January 1769 Pierre married Claire Babin at Pointe Coupée, Pointe Coupée Parish, LA although they were living at San Luis de Natchez. The nearest Catholic Church was Saint Francis de Pointe Coupée Catholic Church about 80 river miles south of San Luis de Natchez. Pierre and Claire left San Luis de Natchez in December 1769 and resettled in Ascension Parish, LA before moving to St. Landry Parish, LA about 1773. They had six sons together before Claire died shortly after the birth of their sixth child in 1780.

With responsibility of caring for six young boys, Pierre married a third time in late 1780 or early 1781 to Marguerite Miller in St. Landry Parish, LA. About 1792 Pierre purchased property in St. Martin Parish, LA and moved his growing family to La Grande Pointe (near today's Cecilia). In 1822 Marguerite Miller died after having 13 children with Pierre.

Over time Pierre acquired vacheries (cattle ranches) and farms that provided him with significant wealth. At approximately 83 years of age, Pierre died at his home at La Grande Pointe on 14 November 1825.

Pierre Guidry's succession provides an interesting peak into the life of a successful Acadian in south Louisiana. The succession is quite detailed and includes small items as a hoe to his home, livestock and enslaved people.

This was the third distribution of Pierre's "estate" as he had divided his estate with his six sons after Claire Babin's death and then again after Marguerite Miller's death with their 11 living children and the descendants of their deceased son Victorin. Three of Pierre's children died in infancy and thus had no descendants.

In the 1800s Louisiana law recognized community property and usufruct. Under community property any assets acquired by the married couple during a marriage were community property and owned jointly. Any assets brought into the marriage by one partner or acquired solely by one partner through inheritance remained that partner's separate property. At the intestate death of a spouse in which the couple had children the community property was equally divided between the surviving spouse and the children of the marriage. The surviving spouse received half of the estate and the children received the other half. Furthermore, the surviving spouse received usufruct over the half of the estate given to the children. Usufruct granted the surviving spouse control of the children's half of the community assets as long as that spouse was living and to use those assets as the surviving spouse wished. For example, the surviving spouse could continue to live in the family house the rest of his life. The children were the "naked owners" of the assets and received these assets fully when the surviving spouse eventually died. Intestate was when a person died without a will.

Marguerite Dupuis died in the summer of 1768; however, she and Pierre Guedry had no estate. They had arrived in Louisiana in February 1768 almost destitute and had not acquired any real assets by the summer of 1768. There also were no children with whom to divide any assets.

Claire Babin died intestate in mid-June 1780. An inventory of the community property of Pierre Guedry and Claire Babin was conducted on 7 January 1781. 2 Their estate was estimated at $2547 piastres and consisted of the family's cypress home (20 feet x 16 feet) with 10 arpents frontage on Bayou Carencro by 12 arpents deep, another piece of land with no structures or fences with 10 arpents frontage, a 17-year-old Mulatress and various household and farm items. No division of the estate was noted as Pierre Guedry had usufruct of it. On 14 December 1825 David Guedry, acting for himself and his five brothers, stated that they had peremptorily settled their share of their mother's estate with their father Pierre Guedry and that he had made them whole. 3 Claire Babin and Pierre Guedry had been married 11 years at the time of Claire's death and the young couple had just begun acquiring significant assets.

Marguerite Miller died intestate on 22 October 1822 in St. Martin Parish, LA. She and Pierre Guedry had acquired significant assets during their 41-year marriage. They had assets in both St. Martin Parish, St. Landry Parish and Lafayette Parish. The succession of Marguerite Miller is quite complex with an inventory in three parishes, six separate auction sales, many notes owed to the estate and a distribution of assets to her surviving husband and 12 children. 4 Their St. Martin Parish and St. Landry Parish community property was inventoried 24 February 1823 and had an estimated value of $87,557. The inventory included 23 separate pieces of land totaling 4400 arpents, 78 enslaved men, women and children, various farm equipment, household goods, cattle and horses and 43 obligations (loans) owed to the community property totaling $18,713. Between 26 February 1823 and 20 August 1823 six public auctions occurred to dispose of the community property in St. Martin and Lafayette Parishes. The total value of the community property between Marguerite Miller and Pierre Guedry was $112,026.21. After subtracting the court costs and claims against the estate of $10,225.61, the amount of estate funds available for distribution was $101,800.60 of which half went to Pierre Guedry ($50,900.30) and the other half went to the 12 children of the marriage of Marguerite Miller and Pierre Guedry ($4241.69 each for the 12 children).

After subtracting the amount Pierre Guédry gave to his children with Claire Babin ($5200), his cash on hand at the time of Marguerite's death ($2000), his purchases at the auction sales ($27000.05) and notes he owed ($5,183.03), Pierre received $11,517.22. Pierre's purchases at the auction included his house, two pieces of land, 23 enslaved people and various farming and household items. Pierre's total estate was now $40,517.27 (auction purchases, cash on hand and cash received from distribution of estate). Although still a substantial amount of money for that time period, Pierre's estate had decreased by more than 63%. The average inflation rate from 1823 to 2025 has been 1.71%, thus the inflation multiplier is 30.62 for this time period. The $112,026.21 estate in 1823 would be valued at $3,430,243 today. Pierre Guedry's residual estate after the distribution and subtractions ($40,517.27) would be valued at $1,240,639 today.

When Pierre Guedry died on 14 November 1825 at La Grand Pointe (near present-day Cecilia) in St. Martin Parish, LA, he left an estate valued at $18,571.86 based on the sale of his assets at public auction. 5 It had been only two years since his spouse Marguerite Miller had died and he had lost over 63% of his assets in her succession settlement. He was an older man in 1825 - being over 80 years of age. Most of his 1825 estate included farming implements, household goods, 17 enslaved men, women and children, some livestock, some corn, potatoes, cotton and hay and the furniture of one daughter Felonise, who was in the convent. Likely much of the assets that he had after the 1823 succession settlement had been given to his children during the ensuing two years. Still $18,571.86 in 1825 was a considerable sum worth $603,028 in 2025. In his Last Will and Testament dictated on 7 November 1825 he set free at his death one enslaved woman Lalie (age of about 31) and her two daughters Louise, (age of about 8) and Adelle (age of about 5) because of kind and loyal services for over twenty-five years. 1

Brief Definitions of Unfamiliar Terms

  • Piastre - Major unit of currency used in colonial Louisiana during French, Spanish, and early American governments. The symbol $ was usually used to refer to piastres in colonial Louisiana. Often called a dollar.
  • Escalin - One-fourth or quarter of a piastre, or commonly two bits.
  • Picaillon - One eighth of a piastre, or commonly a bit.
    Interesting facts: The piastre could be cut into eight pieces or picaillons. Two picaillons equaled one escalin. The picaillon was called a bit. Thus, you may recall the football cheer: "2 bits, four bits, 6 bits, a dollar" (one piastre or 8 bits). Also, the New Orleans Times Picayune newspaper got its name because it cost a picaillon to purchase a copy of the newspaper.
  • Ells - An old measure of length primarily for textiles, equal to six hand breadths (about 45 inches).
  • Boffart (Beaufort) - A type of cloth.
  • Demijohn - A large glass or earthenware bottle used to transport liquids. May have a wicker cover.
  • Flagstone - Sedimentary rock used as a paving material or in construction. Often brought to Louisiana as ballast in ships.
  • Carding Brush - A wooden handled brush used in preparing cotton and wool for spinning and weaving. They removed debris, untangled fibers, and aligned the fibers.
  • Harrow - A farm implement used after initial plowing to break up clods and do the initial smoothing of soil.
  • Necessary - An outhouse (or, in today's parlance, toilet) situated away from the main house with no utilities.
  • Bureau - A flat-topped writing desk that was unique to Acadian Louisiana.
  • Sceptre - Perhaps a walking stick.
  • Spanish horse - A horse breed descended from Iberian horse stock from Spain. They are generally small horses with specific characteristics.
  • Pirogue - Somewhat similar to today's canoes except the bottom is flat with no keel. Usually made of cypress using a "dug out" technique. Can traverse narrow, very shallow areas such as marshland.

The paragraph at the very end of the succession sale mentions that all items were sold except the land mentioned in the 1 st article of the Inventory. The 1 st article of the Inventory states "A residence located in the Parish of St. Martin having nine arpents of land facing the left bank of bayou Teche with a depth of forty arpents bounded above by the land belonging to and below by the that of Mr. Cyrille Thibodeaux all together the Buildings and other dependences of the said residence worth the sum of three thousand eight hundred piastres. That is to say two thousand piastres the land and eighteen hundred piastres the establishment."
